1. Eligibility: This raffle (the “Raffle”) is open only to those who enter by purchasing one or more official Raffle tickets (“Ticket” or “Tickets”). Ticket purchasers must be 18 years of age or older. The Raffle is only open to legal residents of the United States of America. The Raffle is subject to all applicable federal, state and local laws and regulations. The Raffle is void where prohibited by law.
2. Agreement to Rules: By participating, you agree to be fully and unconditionally bound by these rules (the “Rules”), and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Raffle Chairperson as final and binding as it relates to the content. The Raffle is subject to all applicable federal, state and local laws.
3. Raffle Ticket Purchase Period: Tickets may be purchased beginning on or about September 18, 2023 and ending November 19, 2023 at 7:00 p.m. Eastern time.
4. Raffle Ticket Prices:
Price Point A – $25 per individual Ticket
Price Point B – $100 per group of five Tickets
5. Ticket Purchasing Options:
Cash or Check – Tickets may be purchased with cash or check from authorized Ticket sellers. Tickets that are not complete or do not adhere to the Rules may be disqualified at the sole discretion of the Raffle Chairperson. You must completely fill in the information requested on the Ticket. If you use fraudulent methods or otherwise attempt to circumvent the Rules your submission may be removed from eligibility at the sole discretion of the Raffle Chairperson.
Electronic Payment – Tickets may be purchased using electronic payment methods at https://gpsouthchoir.charityraffles.org. The electronic payment form must be completed fully and accurately. Orders that are not complete or do not adhere to the Rules may be disqualified at the sole discretion of the Raffle Chairperson. If you use fraudulent methods or otherwise attempt to circumvent the Rules your submission may be removed from eligibility at the sole discretion of the Raffle Chairperson. Electronic payments will only be accepted until November 19, 2022 at 7:00 pm Eastern time.
6. Additional Conditions: No refunds will be issued except in the limited circumstance outlined in Section 9 herein. Any incomplete or illegible entries will not be processed. The use of manipulated, mutilated, altered or photocopied entries, or like methods, is strictly prohibited. Grosse Pointe South Choir Boosters, Inc. is not responsible for incomplete, invalid or unintelligible Tickets, which will be disqualified and destroyed. In the event of a dispute as to the ownership of any Ticket, the information contained on the Ticket will be deemed to be the entrant. All entries must be made in the name of an individual and no transfer of ownership of a Ticket is permitted. No entries will be accepted from or on behalf of, corporations, trusts, partnerships, or other entities.
7. Prizes: Winners will be selected for the following prizes, in the following order:
TWO (2) prizes of USD $250.00 each
ONE (1) prize of USD $500.00
ONE (1) prize of USD $1,000.00
ONE (1) prize of USD $2,500.00
No other prize substitution permitted. The prize is nontransferable. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for Grosse Pointe South Choir Boosters, Inc. to use winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
8. Odds: The odds of winning depend on the number of eligible Tickets entered at the time of the drawing.
9. Winner selection and notification: Winners of the Raffle will be selected in a random live drawing under the supervision of the Raffle Chairperson. The Raffle drawing will be open to the public. All entries will be placed in a receptacle that affords each Ticket an equal opportunity to be drawn. Each prize shall be announced prior to each Ticket drawing, and winning Tickets shall be drawn randomly, one at a time. WINNERS NEED NOT BE PRESENT TO WIN. Winning tickets shall be removed from any subsequent drawings.
If circumstances prevent the drawing from taking place inside the location listed on the license, it will take place in front of the drawing venue on the same day and at the same time. If circumstances prevent the drawing from taking place on the day and time listed on the license, all entries will be notified of the new drawing date and time, and will be offered the option to receive a refund of their entry fee(s).
Winners will be notified via the contact information provided within three (3) days following the winner selection. Grosse Pointe South Choir Boosters, Inc. shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If a selected winner cannot be contacted or fails to claim the prize within 60 days from the date of the drawing, or fails to timely return a completed and executed declaration and releases as required, their prize may be forfeited and donated to an alternate charitable organization.
The receipt by winner of the prize offered in this Raffle is conditioned upon compliance with any and all federal and state laws and regulations, including the accurate and signed submission of any required tax withholding forms. ANY VIOLATION OF THESE RULES BY ANY WINNER, AT THE SOLE DISCRETION OF THE RAFFLE CHAIRPERSON, WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE RAFFLE AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
10. Rights Granted by you: By entering this contest you understand that Grosse Pointe South Choir Boosters, Inc., anyone acting on behalf of Grosse Pointe South Choir Boosters, Inc., or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Raffle, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
11. Terms: Grosse Pointe South Choir Boosters, Inc. reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Raffle should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Raffle. In such case, Grosse Pointe South Choir Boosters, Inc. may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Grosse Pointe South Choir Boosters, Inc.
Grosse Pointe South Choir Boosters, Inc. reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Raffle or website or violates these Terms & Conditions.
Grosse Pointe South Choir Boosters, Inc. has the right, in its sole discretion, to maintain the integrity of the Raffle, to void entries for any reason. Any attempt by an entrant to deliberately damage any Raffle equipment or technology, or to undermine the legitimate operation of the Raffle may be a violation of criminal and civil laws and should such an attempt be made, Grosse Pointe South Choir Boosters, Inc. reserves the right to seek damages from any such person to the fullest extent permitted by law.
By entering the Raffle you agree to receive email communications periodically from Grosse Pointe South Choir Boosters, Inc. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in correspondence.
12. Limitation of Liability: By entering the Raffle you agree to release and hold harmless Grosse Pointe South Choir Boosters, Inc. and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Raffle and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Raffle; (v) electronic or human error which may occur in the administration of the Raffle or the processing of entries.
13. Disputes: THIS RAFFLE IS GOVERNED BY THE LAWS OF THE STATE OF MICHIGAN, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Raffle, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Raffle, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the State of Michigan having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Raffle), and participant further waives all rights to have damages multiplied or increased.
14. Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the Grosse Pointe South Choir Web Site located at www.gpsouthchoir.org.
15. Winners List: To obtain a copy of the winner’s name or a copy of these Rules, mail your request along with a stamped, self-addressed envelope to: Grosse Pointe South Choir Boosters, Inc., Attn: Raffle Chairperson, 11 Grosse Pointe Boulevard, Grosse Pointe Farms, Michigan 48236. Requests must be received no later than 60 days after the drawing date.
16. Sponsor: The Raffle is organized and operated by: Grosse Pointe South Choir Boosters, Inc., 11 Grosse Pointe Boulevard, Grosse Pointe Farms, Michigan 48236.
